Well, "Open Software" isn't trademarked (is it?). Moreover, it's a natural
variant of more familiar terms such as "Open Standards" and "Open Systems"
while connoting something positive without being specific. A marketer's
dream!

Not in my experience. I still encounter many media types who believe that
"GPL'd software cannot be sold for a profit - it must only be given away
for free" :-(
